Appealing a Denial of Your Gun Permit

Gun purchase permits are appealed to Superior Court and generally result in a hearing before a Superior Court judge.  However, carry concealed handgun permits are generally addressed by writing only, do not involve a hearing, and are presented to the Chief District Court Judge in the county of the applicant’s residence.

Regardless of which court the appeal is taking place, a knowledgeable attorney like Candace Seagroves can help you present your best basis for an appeal, prepare and articulate an argument to support your position, and assist you in demonstrating the reasons the denial should be overturned.

Before Appealing Your Gun Permit Denial, First Examine the Reason for Denial

When the Sheriff denies your gun permit, you must be provided a notice of the denial – most commonly this is an email.  Sometimes, the reasons are such that require a course of conduct that would not involve an appeal of the denied gun permit.  For example, if they discover you have a prior conviction of an offense that prohibits you, or you have been deemed mentally defective due to a mental health commitment.  In those instances, we would want to help you address the underlying reason for the denial by helping you remove any firearm disability or expunge your criminal conviction.

In some cases, however, the Sheriff claims that there is a mental infirmity or a substance abuse issue based on mental health records they receive.  Keep in mind you are consenting to them obtaining this information when you apply for the concealed carry permit. In these cases, an appeal may be your better option.  It is advantageous to have a skilled attorney like Candace Seagroves to assist you with developing a strong appeal to persuade the court to override the denial.   Seagroves Legal can help you through this process and has done so successfully for numerous clients.
